Terms of Service

These Terms of Service ("Terms") govern access to and use of the Mindful Bookings platform (the "Service"). By requesting a demo, becoming an authorized user, or otherwise accessing the Service, you agree to these Terms.

1. The Service

The Service provides internal scheduling, optimization, and related analytics for clinics and similar organizations. We may update features to improve reliability, security, or usability.

3. Customer Responsibilities

You are responsible for: (a) accuracy of data entered; (b) maintaining appropriate internal access controls; (c) complying with all applicable regulations (e.g., healthcare, labor) in your jurisdiction.

4. Data Ownership

Customer retains ownership of all scheduling and operational data entered into the Service. We receive a limited license solely to process that data in order to provide and improve the Service.

5. Confidentiality

We will not disclose customer confidential information except to personnel, subprocessors, or advisors who need it to operate the Service and are bound by confidentiality obligations.

6. Security

We employ commercially reasonable safeguards. You acknowledge no system is 100% secure and agree to notify us promptly of suspected issues.

7. Intellectual Property

The platform code, optimization methods, and interface design remain our intellectual property. No rights are transferred except those expressly granted for use of the Service.

8. Warranties & Disclaimers

The Service is provided "as is" without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific scheduling outcomes.

9. Limitation of Liability

To the maximum extent permitted by law, aggregate liability for any claim arising out of these Terms or the Service will not exceed fees paid (if any) in the 3 months preceding the event giving rise to liability. We are not liable for indirect, incidental, or consequential damages.

10. Term & Termination

Access continues while (a) you are in an active onboarding/demo phase or (b) you are an active paying customer. We may suspend access for material breach or security risk.

11. Subprocessors

We may use reputable infrastructure or email providers. You can request a current list at legal@mindfulbookings.com.

12. Changes to Terms

We may update these Terms; material changes will be communicated or dated here. Continued use after changes constitutes acceptance.

13. Governing Law

Applicable law will be that of the state or jurisdiction where we primarily operate (unless overridden by mandatory local law).
